Massachusetts’ No-Fault Insurance System

Massachusetts is one of a dozen states that follows a “no-fault” insurance system. Under this system, drivers are required to turn to their own insurance carrier for coverage of their medical expenses, lost wages, and other out-of-pocket losses, regardless of who caused the accident. While this system is designed to help speed up the process of those involved in an accident securing compensation, it does limit how much compensation can be recovered. For example, in a no-fault claim, injury victims cannot secure compensation for pain and suffering or other non-monetary losses.

However, it is possible to step outside of the no-fault system if certain thresholds are met in the accident. Under Massachusetts law, the following conditions must be met in order for an accident victim to step outside of the no-fault rules:

  • The injury victim must have incurred at least $2,000 in reasonable medical expenses, and/or
  • The injuries resulting from the crash must include broken bones, permanent or serious disfigurement, or substantial loss to hearing or sight.

When the injuries qualify under this definition, the injury victim is allowed to file a claim against the at-fault driver’s insurance carrier to recover compensation. They can also file a personal injury lawsuit against the at-fault driver, if necessary. When this occurs, the injury victim can pursue pain and suffering damages as well as any other non-economic losses that were not available through the no-fault system.

Drivers in Massachusetts are required to carry a certain amount of insurance minimums. The law requires the following:

  • $20,000 liability coverage for bodily injury per person (for an accident you cause)
  • $40,000 total liability bodily injury coverage (per accident you cause regardless of how many are injured)
  • $5,000 liability coverage for property damage (for an accident you cause)
  • $8,000 in no-fault (PIP) coverage
  • Uninsured motorist coverage at $20,000 per person and $40,000 total per accident
